Who is Responsible?

Association Responsibilities

Your homeowners association is responsible for the maintenance of the common areas within the community. This includes the maintenance and repair of common landscaped areas, private streets, painting of exterior building surfaces, common area lighting, recreation facilities and roofs. These responsibilities are outlined in the governing documents and are not at the discretion of the Board of Directors or the management company.

In addition to maintenance responsibilities, the association, through the elected Board of Directors, is charged with the task of ensuring that the members of the community are aware of, and adhere to the stipulations outlined within your associations' governing documents. These documents were passed along to you by your escrow officer at the time of your purchase. They include the Association By-laws and the Covenants, Conditions and Restrictions (CC&R's). As these documents define the responsibilities of the association, its membership, and the regulations governing all members of the association, it is important that you become familiar with them. If you did not receive these documents at the close of escrow, please contact us and we will provide you with copies of them.

Member Responsibility

Upon purchase of a home within this community, you have agreed to certain areas of responsibility and compliance with the existing policies, as well as policies which may be adopted by the Board of Directors in the future.

While the association is responsible for the maintenance of the common area components, you as an owner are responsible for all components which are for your exclusive use. This includes the entire interior of your unit, all plumbing contained within your unit, (including individual water pipes) and any outside areas which are reserved for your exclusive use (patios, decks and garages), sidewalks and driveways, maintenance and repair of the entire exterior structure surface (excluding painting), as well as the maintenance and repair of all glass windows and doors.

In addition to maintenance of your unit and compliance with association policies each homeowner is a “stock-holder” within this corporation. It is the stock-holders who determine who, within the association, will hold a seat on the Board of Directors, who you empower to make the policies and decisions that affect all of the membership.

Board of Directors Responsibility

All unit owners are entitled to, and encouraged to run for the Board of Directors. The Board of Directors is elected at your Annual Meeting. Notice of this meeting will be sent to you by the management company, 30 days prior to the meeting date.

The business of the corporation is handled exclusively by the Board at their regularly scheduled meetings. The membership is informed of scheduled Board meetings via your newsletter, or a notice sent by your management company. All homeowners have the right to observe Board meetings, but not the right to participate. There is a short “open forum” prior to the meeting. This is the opportunity for members to put forth any comments or questions they wish the Board to consider at future meetings. As time is limited all questions and requests must be deferred to future meetings.

Community Property Management Responsibilities

It is our task to manage three general areas of responsibility: 1) Maintenance 2) Finances and 3) Administration. These areas include, but are not limited to, the supervision of all association vendors and contractors, the scheduling of all association maintenance, administration of assessment collection, the Associations financial responsibilities, (i.e., taxes, bank accounts, budgets), and the enforcement of the policies made by your Board of Directors.

For your convenience, we operate a 24-hour answering service. In case of an emergency, such as a fire, during non-routine business hours, your message will be forwarded to a member of our staff for appropriate action. We would like to stress that in the case of an emergency such as a fire that you dial 911 before contacting us. We are unable to contact emergency services for you as emergency services are dispatched according to the originator of the call. Although we can be contacted after normal business hours, we can only address emergency situations at that time. If you have questions or need assistance concerning maintenance, association regulations or the like, please contact us during normal business hours. We are open Monday – Thursday 8:30 am to 5:00 pm and Fridays 8:30 am to noon.
