Routine Management and Financial Services Provided by
Community Property Management
- Attend One Annual Meeting of the members, and up to 11 additional meetings of the Board of Directors.
- Prepare all notices of meeting and agenda for Board and membership meetings.
- Maintain and transcribe the Minutes and all Official Records of the Association.
- Advise the Board on matters within the scope of Management. Community Property Management shall not be accountable for legal opinions solicited by the membership or the Board.
- Prepare all policies and rules for approval by the Board or the members as is the requirement of the Governing Documents. Said preparation of policies and rules are in addition to those policies prepared initially during the setup.
- Maintain normal office hours for the convenience of the members and companies doing business with the Association and provide a twenty-four (24) hour emergency phone number and answering service.
- Be the "Legal Agent of Service" for all legal and corporate notices.
- As Agent of the Board cause the following to be signed:
- Maintenance and Service Agreements.
- State, Federal and, if any, local tax returns.
- Liens.
- Release of Liens.
- Suits & Judgments.
- Domestic Corporations filing (annually).
- And such others as are appropriate and consistent with the purposes and powers of the Agent as more specifically set forth in the executed Agreement.
- Receive all invoices, billings, and statements belonging to the Association.
- Prepare all checks, drafts and disbursements in accordance with Civil Code 1365.5 of the Civil Code of California.
- Inform the members of the Board of matters requiring the Board's approval, advice or consent.
- Community Property Management will direct the preparation of financial reports in accordance with generally accepted accounting practices and in accordance with Civil Code 1365.5
- Obtain approval from the Board for special projects not covered in other policy decisions of the Board or the executed Agreement.
- Provide "Homeowner Services" as defined in the governing documents.
- Provide Reserve Funding recommendations and initial draft of Annual Operating Worksheet.
- Provide monthly financial package.
- Provide routine site inspections as decided.
- Issue notices and violation letters up to, but not including the Notice of Hearing.
